K-L District Sued Over Student's Injuries From Water Balloon

Stacy Katz is suing Katonah Lewisboro Schools for $75,000.

A mother of a student has sued the district on her behalf, claiming her daughter suffered a ruptured eardrum and bleeding in her left ear as a result of being forcefully struck by a water balloon on the last day of classes in 2011.

Stacy Katz, a resident of New Hampshire, filed the lawsuit on her daughter's behalf July 31 because she is a minor, according to federal court documents obtained by Patch.

Katz alleges that her daughter (referred to in the lawsuit as AOK) is now sensitive to loud sounds including music played "at normal teenage volume"  and continues to suffer pain, mental anguish and a restriction of normal activities as a result of being hit by a water balloon when she was a sophomore on campus June 9, 2011.

The lawsuit also describes the immediate impact of the student's injuries last year as causing terror and severe pain and preventing the student from swimming for the entire summer following the incident.

The lawsuit claims the district "recklessly and negligently" failed to instruct students on avoiding injury when delivering senior pranks on the last day of classes.

As a result of the suit's claims, the family seeks $75,000 in damages.
