Woman Accusing Mt. Kisco Cops of Strip Search Gets Lawsuit Sealed

The woman has been reported in the media as filing a civil rights suit against Mount Kisco.

 

A woman who has been reported to be claiming that two Mount Kisco police officers engaged in an invasive strip search before receiving a driving while intoxicated court date ticket, has successfully gotten a related civil suit against the village sealed.

The seal order was given Friday after a successful motion made on behalf of the woman. The plaintiff’s lawyer, Alissa Boshnack of New York City-based Fisher, Byrialsen & Kreizer, confirmed the suit and told Patch about the seal order, but declined to give any further details relating to the case because of its sealed status. A search for the federal suit on Monday was unsuccessful.

The lawsuit was first reported over the weekend by The Journal News, which obtained a copy of the civil complaint that was filed on Aug. 15 in U.S. District Court. The suit, the paper reports, claims that police violated the woman’s civil rights by doing the strip search, and calls for $2 million in damages.

According to the complaint, as reported by the paper, the 19-year-old Bedford woman claims that on an August 2010 early morning, she was detained after a traffic stop while coming back from a night out with friends. It states, the paper reported, that she was then searched under her dress by female and male officers at the station, and also touched on her breasts by the male officer. The complaint, according to the paper, also criticizes Mount Kisco Police Chief Steven Anderson for his response to the matter. Anderson, who is in the Marine reserve, is currently on deployment and is not running the department at the moment.

A clerk at Mount Kisco’s Justice Court, when asked about a follow up status on the woman’s DWI case in the village, said there was nothing on record to give. As for whether or not criminal charges are being pursued against the police officers, Lucian Chalfen, a spokesman for the Westchester County District Attorney’s office, said they have not been contacted and explained that there is no investigation. When asked if criminal charges would be sought, Boshnack declined to comment.

Moving forward, dates for the suit are not yet known. Boshnack declined to give any dates for future court appearances, while James Randazzo, an attorney for Mount Kisco, told The Journal News that they would respond to the lawsuit by the end of this month. Randazzo could not be reached Monday for comment.

When asked for a response, Village Manager James Palmer, who handles day to day operations for Mount Kisco, declined to comment.

Boshnack, when asked if the woman would also pursue a civil suit in state court, declined to comment.
