Police: Landscaper Punches UPS Driver, Faces Assault Charges

A self-employed Bedford Hills man was charged with assault.

The information below was provided by Bedford police and does not indicate a conviction.

A landscaper working at a Haines Road residence was arrested Monday after he punched and broke the nose of a UPS driver after accusing him of coming up the driveway too quickly, Bedford police said.

Police responded to a 911 call from the driver, who locked himself inside his truck after the alleged assault. Upon their arrival, police interviewed the driver, who said the landscaper, Guido Enrique Morales-Acevedo, had yelled at him for driving too fast. He said he attempted to tell him he didn't think he was speeding, but the landscaper began screaming profanities and punched him in the nose.

The driver suffered lacerations to his face and said he was in severe pain. He was taken to Northern Westchester Hospital where he learned his nose was broken.

Morales-Acevedo, 33, of Bedford, was charged with third degree assault with intent to physically injure. He was arraigned by Judge Erik Jacobsen and released on $500 bail pending a return to town court.

Mr. Dieck, is that the best comment you could come up with? Your words drip with racist and unnecessary retoric. The issue isn't whether or not he had papers; he should have kept his hands to himself. Let's all try a little harder to be civil to each other.

Anne and Jumpin why is it you defend the notion of someone breaking our laws? Why is it that you jump to the excuse of racism? Mr.Acevedo should definitely have kept his hands to himself...that goes without saying. But he still could be here illegally. There is enough crime in this country without wanting to have illegals add to it. If they weren't here they couldn't commit crimes.....lets face it.....they showed no respect for our laws when they crossed our borders !

Smith-I will let Anne defend herself, but as for me, I am not defending any such thing. Put on your glasses and re-read my post. I am sure you use contractors-check their papers much? Or are you just happy to have some cheap labor. Hip-Hippocrite!

Thank you Deborah. Anne & John, I am not a racist at all. Actually I am in favor of anyone who is in this country illegally to have the right to stay and become a citizen. I have the greatest of respect for these hard working people who frankly do jobs that others won't. I am also in favor of deporting people who do not want to abide by our laws. That being said. Live and let live is great, just don't punch me in the nose if I do something you don't agree with.

I think you should put on your glasses and read your post because your comment "that should be the first thing they check. you must be from Arizona." certainly sounds like you think the possibility of them being illegal is a non issue and it also sounds like you have a problem with Arizona defending itself from illegals.

Tom....by virtue of the fact that illegals cross our borders already show that they do not value laws. As for the fact that they do work others won't do.......that is the fault of our generous give away programs in this country. Seems our government loves to give away other peoples hard earned dollars. Able bodied people collecting welfare, families that are generational recipients. There is one constant in this equation....people have to eat....if our government would stop making it so easy for people to get " free money" they would take these jobs that you say nobody wants.....but as long as they are getting free money why should they?

Deborah, in no way did I defend the notion of someone breaking our laws. I did not offer "the excuse of racism. " Please reread my post. My initial comment was that Tom went right to racist retoric instead of blasting the inexcusable behavior. I completely support the notion that our borders should be protected, illegal aliens should be sent back, and eveybody should do their share. That means legally working your tail off to feed your family. Illegals cross the border for the same reason your families did. There are differences today, and I understand that. I simply suggest that addressing the illegal alien issue in a more civil manner would move us in a more productive way than nastiness will. Tom, I hope that you can understand where I was coming from in my comments to you. The immediate reaction of "does he even have papers" made me cringe. It dripped of racism to me. Thank you for your clarification.

Thank You Anne for your reply. I can understand how you felt that way. I am in the industry. I see more hatred for illegalls than I care to share. My comment was referring to the climate of the system. And this is not directed to this police department. I watched a worker of mine get deported for doing something illegal a few years ago. It was disturbing to me to see him leave mainly because I did not know that he was here illegally. He provided all of the papers required in order for me to employ him. He was a really good worker and person. But, he got involved in something that was illegal and if you are not here legally, I feel that you should go home if you cannot abide by our laws. As for the direction this blog is heading, I will definately not post before I have my first cup of coffee.

Ann I apologize if I misunderstood your comments . It just so happens that the majority of illegals in this country are crossing our southern border so one jumps on a spanish name more immediately than othe nationalities. Make no mistake though, I am against all illegals regardless of their origin. If we Americans don't stand up and insist that our laws be followed then somewhere we lose a little bit of respect from the rest of the world. Political correctness will not solve this problem, only the enforcement of our laws will.

Calling people racist all the time is not productive. If millions of white blonde haired blue eyed Swedes moved in to our country illegally, taxing resources, getting paid cash and not paying taxes (oh, sorry aside from sales tax - hah, big deal), and sometimes committing crimes - what would you guys who call everyone a racist who merely questions a situation involving a foreign born person or person of foreign heritage say then? I know the road where this happened and the UPS guy there is white - maybe the contractor is racist!

Portia I know the driver well and he is white ( actually my husband knows him well) I agree with you whole heartedly....If a black person commits a crime you don't go looking for a white guy. If a white guy commits a crime you don't go looking for a black guy. If a man commits a crime you don't go looking for a woman....I wonder what half of these people that want to allow illegals the right to stay here would say if the influx of illegals were lets say.....were Al Qaeda...oh but they were the law abiding kind.....How about millions and millions of illegal Iranians.....or Millions and millions of people from Iraq?.....It's a shame that the American hispanics are all for the illegals that are here even though they are breaking our laws....I wonder how many of them would be fighting for the other nationalities I mentioned if they were here illegally taking jobs from Americans

Make a living?? Those who are in the trades that are CITIZENS of this country have lost much of their work to people who are "...trying to make a living..." What about those they have undercut because they don't pay taxes, or insurance, etc??? They can't make a living anymore because of these people. And racist I am not - just part of society who can't make ends meet because of this. I have every right to want them gone so I can feed my family and pay my bills.
